Terms of Service – Dr Fiona Tassoni Melbourne Clinic

These Terms of Service set out the conditions under which Dr Fiona Tassoni, MASc, BHSc, Doctor of Chinese Medicine, provides fertility and general health services through the Melbourne clinic and this website. The clinic is located at Level 3, Suite 317, 566 St Kilda Road, Melbourne VIC 3004, Australia.

By booking an appointment, attending the clinic or using this website, you agree to be bound by these Terms of Service and by our Privacy Policy.

1. Clinic Services

Dr Fiona Tassoni provides Chinese medicine consultations that may include acupuncture, Chinese herbal medicine, dietary and lifestyle advice and related holistic care, with a particular focus on fertility and hormonal health.

Services are offered:

• In person at the Melbourne clinic
• Via telehealth or Zoom style video consultations, where clinically appropriate

Services are not emergency medical services and are not a substitute for hospital care or urgent medical treatment.

2. Eligibility and Patient Responsibility

To use our clinical services you must:

• Be at least 18 years of age, or have a parent or legal guardian provide consent if you are under 18
• Provide accurate, current and complete information in your intake forms and during consultations
• Inform the practitioner of all medications, supplements and treatments you are currently using
• Seek immediate medical attention by calling 000 or attending the nearest emergency department in the event of a medical emergency

You are responsible for following any treatment plan or recommendations given and for informing the clinic of any changes to your health, medications or circumstances that may affect your care.

3. Appointments, Cancellations and No Shows

3.1 Booking

Appointments can be booked online through our Cliniko booking system, by telephone or in person. When you book, you agree to these Terms of Service and to any fees listed at the time of booking.

3.2 Cancellation and Rescheduling

To allow fair access to appointments, we require reasonable notice if you need to cancel or reschedule. Unless otherwise specified on the booking page or in your confirmation email:

• Cancellations or reschedules with at least 24 hours notice will generally not incur a fee
• Short notice cancellations or failure to attend may incur a cancellation fee up to the full consultation fee

Specific cancellation windows and fees may be updated from time to time and will be stated on your booking confirmation or clinic communications. By booking, you agree to any applicable cancellation policy in place at that time.

3.3 Clinic Changes

On rare occasions, we may need to reschedule or cancel your appointment due to practitioner illness, emergencies or unforeseen circumstances. If this occurs, we will contact you as soon as reasonably possible to arrange a new appointment time. We are not liable for any costs or losses incurred by you as a result of such changes.

4. Fees, Payment and Refunds

Current consultation fees and package prices are displayed on the clinic website or booking pages. Fees may change without prior notice, however the fee applicable to you is the fee stated at the time you make your booking.

Unless otherwise specified:

• Payment is due at the time of consultation for in clinic appointments
• Telehealth or Zoom consultations may require payment before or at the time of the session
• Herbal prescriptions and products are billed separately from consultation fees

Herbal products, supplements and preparations are supplied for therapeutic use only. For safety and regulatory reasons, we are generally unable to provide refunds on opened herbal prescriptions or products, except where required under Australian consumer law.

Nothing in these Terms of Service limits your rights under the Australian Consumer Law.

5. Telehealth and Zoom Consultations

Telehealth consultations are offered for patients who cannot attend the Melbourne clinic in person and where telehealth is clinically appropriate.

By booking a telehealth session you acknowledge that:

• Telehealth relies on third party technology and internet connections and may occasionally be disrupted
• There are limits to what can be assessed or treated without a physical examination
• You are responsible for ensuring you are in a private and safe location for your consultation

If a telehealth consultation is not suitable for your needs in the opinion of the practitioner, you may be advised to attend the clinic in person or to seek care from another provider.

6. Health Information and Privacy

We handle personal and health information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, the Health Records Act 2001 (Vic) and our clinic Privacy Policy.

By using our services, you consent to the collection and use of your information as described in the Privacy Policy, including the use of secure third party platforms such as Cliniko for appointments and record keeping.

Our current Privacy Policy is available on the clinic website and forms part of these Terms of Service.

7. No Guarantee of Outcomes

Fertility and health outcomes depend on many individual factors. While Dr Tassoni will always act with professional care and skill, no specific outcome, pregnancy or health result can be guaranteed.

Any examples, case studies or testimonials on this website or in clinic materials represent individual experiences and do not guarantee that you will achieve the same results.

8. Website Content and Educational Material

Information on this website and in any eBooks, videos, emails or educational material provided by the clinic is general information only. It is not a substitute for personalised medical advice, diagnosis or treatment from your doctor or other qualified healthcare provider.

You should not disregard or delay seeking conventional medical advice because of something you have read on this website or in our materials.

9. Limitation of Liability

To the fullest extent permitted by law:

• We exclude all warranties, representations and conditions that are not expressly stated in these Terms of Service
• We are not liable for any indirect, incidental, special or consequential loss, or loss of profits, arising out of the use of our website or services

Where liability cannot be excluded under Australian law, our total liability is limited, at our option, to the resupply of the relevant service or the cost of having the service resupplied.

10. Third Party Services and Links

Our website and telehealth services may use or link to third party platforms including Cliniko, Zoom style services, email and payment providers.

We are not responsible for the content, privacy practices or security of third party websites or platforms. Use of those services is subject to their own terms and policies.

11. Intellectual Property

All content on this website, including text, graphics, logos, videos, images and educational resources, is owned by or licensed to Dr Fiona Tassoni unless otherwise stated. You may not reproduce, distribute or adapt any content without prior written permission, except as permitted by law for personal use.

We may update these Terms of Service from time to time to reflect changes in law, clinical practice or technology. The most current version will be posted on this page with an updated Effective Date. Your continued use of the website or clinic services after changes are posted indicates your acceptance of the updated terms.

13. Governing Law

These Terms of Service are governed by the laws of the State of Victoria and the laws of the Commonwealth of Australia. You agree to submit to the non exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
